Terms of Service

1. About Wally

Wally is a housing matchmaking service operated by Nvoye B.V., a company registered in The Hague, Netherlands (KVK: [to be inserted]). Wally connects housing seekers with people offering rooms or looking for housemates in the Netherlands, primarily through WhatsApp.

By using Wally, you agree to these Terms of Service. If you do not agree, please discontinue use of the service.

2. The Service

Wally provides:

  • Housing matching: Connecting seekers with compatible rooms and housemates based on budget, location, timing, and lifestyle preferences
  • Introductions: Facilitating direct WhatsApp introductions between matched parties after mutual consent
  • Follow-up: Checking in after introductions to support successful outcomes

Wally is a matching and introduction service only. We are not a party to any rental agreement, sublease, or housing contract between users. We do not guarantee housing availability, suitability, or the outcome of any introduction.

3. Eligibility

To use Wally, you must:

  • Be at least 18 years old
  • Have a valid WhatsApp account
  • Provide accurate and truthful information about yourself, your housing needs, or your listing
  • Have the legal right to offer the room or property you list (if applicable)

4. How Matching Works

  1. Profile creation: You chat with Wally on WhatsApp and provide your preferences (seeker) or listing details (offerer)
  2. Matching: Wally runs matching cycles every 4 hours, scoring compatibility based on the criteria you've provided
  3. Mutual consent: When a potential match is identified, both parties are notified. An introduction only happens when both sides confirm interest
  4. Introduction: Wally introduces matched users directly on WhatsApp. From this point, communication continues between the parties

5. Pricing and Payments

For housing seekers

A service fee of €25 is charged per successful match. A "successful match" is defined as: Wally identifies a compatible room/housemate, and both the seeker and the offerer confirm mutual interest. The fee is charged at the point of mutual confirmation, before the introduction is made.

For room offerers

Listing a room on Wally is always free. Offerers may optionally set a finder's fee (€0–50) which the seeker pays directly if both parties agree. This optional fee is a private arrangement between users and Wally is not a party to it.

Payment processing

Payments are processed through Mollie, a payment service provider regulated by De Nederlandsche Bank. We support iDEAL and other common Dutch payment methods. Wally does not store your payment details.

Refunds

The €25 service fee is non-refundable once the introduction has been made, as the service (matching and introduction) has been delivered. If an introduction cannot be completed due to a technical error on our side, you will receive a full refund within 14 business days.

6. User Responsibilities

By using Wally, you agree to:

  • Provide accurate, current, and complete information about yourself and your housing situation
  • Not misrepresent your identity, the availability of a room, or the nature of a listing
  • Not use Wally for any fraudulent, illegal, or unauthorized purpose
  • Treat other users with respect and communicate in good faith
  • Not share the contact details of other users outside the context of the match
  • Notify Wally when you've found a room or your listing is no longer available

7. Listing Accuracy

If you're listing a room, you represent that:

  • The room is real and available for the stated dates and price
  • You have the right to offer or sublet the room (including any required landlord permissions)
  • The description accurately reflects the property and its conditions
  • Photos or details shared are of the actual room being offered

Wally reserves the right to remove listings and restrict users who provide misleading information.

8. Limitation of Liability

Wally acts solely as a matchmaker and facilitator. We do not:

  • Verify the legal status of any property or rental agreement
  • Guarantee the identity, background, or reliability of any user
  • Bear responsibility for the outcome of any housing arrangement between users
  • Guarantee that a match will be found within any specific timeframe

To the maximum extent permitted by Dutch law, Nvoye B.V. shall not be liable for any indirect, incidental, or consequential damages arising from the use of our service. Our total liability for direct damages shall not exceed the amount you have paid to Wally in the 12 months preceding the claim.

9. Content and Intellectual Property

The Wally name, logo, mascot, website design, and all related materials are the intellectual property of Nvoye B.V. You may not copy, reproduce, or distribute any part of our service or branding without written permission.

Information you share with Wally (profile data, preferences, listing details) remains your data. By using the service, you grant Wally a limited license to use this data for the purpose of providing the matching service and improving our algorithms.

10. Account Termination

You may stop using Wally at any time by messaging "STOP" on WhatsApp or contacting support@nvoye.com.

Wally reserves the right to suspend or terminate access to our service if you:

  • Violate these Terms of Service
  • Provide false or misleading information
  • Engage in fraudulent, abusive, or harmful behavior
  • Use the service for unauthorized commercial purposes

11. Dispute Resolution

If you have a dispute with another user that arose through a Wally introduction, we encourage you to resolve it directly. Wally is not responsible for disputes between users but may offer mediation at our discretion.

Any disputes between you and Nvoye B.V. regarding these Terms shall be governed by Dutch law and submitted to the competent court in The Hague, Netherlands. Before initiating legal proceedings, we encourage you to contact us at support@nvoye.com to attempt resolution.

12. Modifications to the Service

Wally is continuously evolving. We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify active users of significant changes via WhatsApp.

13. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated to active users via WhatsApp at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance of the revised terms.
